Juicy Fruit/Chris Bosh Contest (the "Contest")

RULES & REGULATIONS ("Contest Rules")

Participation in the Contest constitutes full and unconditional agreement and acceptance of these Contest Rules, which are final on all matters relating to the Contest.

  1. Eligibility: No Purchase Necessary. The Contest begins at 11:59 am EDT on Friday, March 27th, 2009 and closes at 11:59 am EDT on Friday, July 3, 2009 (the "Contest Period").

    This Contest is open only to legal residents of Canada 13 years of age and older who live within Canada. All eligible entrants below 18 years of age require parental consent to participate in the Contest. Employees (and their immediate families and those with whom they are domiciled) of Maple Leaf Sports & Entertainment Ltd. ("MLSE"), the Toronto Raptors, Wrigley Canada (collectively the "Contest Sponsors"), and National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies are not eligible to enter.

  2. How To Enter:

    Anytime during the Contest Period, visit www.jf4on4.ca, follow the contest link and fully complete and submit the online entry form.

    Limit one entry per person. Contest Sponsors assume no responsibility for incorrect or inaccurate capture of entry information, including (but not limited to), malfunction, human error, lost/delayed/garbled Internet/e-mail transmission, omission, interruption, deletion, defect, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof. Online entries must be submitted from a valid e-mail account that may be identified by reverse domain name search.

    Entries will be deemed submitted by the authorized account holder of the email address provided as part of the Contest registration process. "Authorized account holder" is defined as the person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Contest Sponsors with government issued photo identification as proof that they are of sufficient age to participate in the Contest. If the personal data provided on the government issued identification does not match the information in the potential winner's Contest entry, the Contest Sponsors reserve the right to disqualify the potential winner.

  3. Prize:

    There is one (1) grand prize (the "Grand Prize") available to be won consisting of:

    • Flight (return) for the Grand Prize winner and the three (3) guests designated by the Grand Prize winner (the "Participants") from the Grand Prize winner's city of residence (or a city to be specified by the Contest Sponsors) to Toronto. In the event the Grand Prize winner resides within 300 km of the city of Toronto, Contest Sponsors will arrange for ground transportation for the Grand Prize winner and the Participants.
    • Two (2) nights standard hotel accommodations in or around Toronto for four (4), double occupancy (hotel to be selected at Contest Sponsors' sole discretion).
    • Four (4) autographed Chris Bosh Toronto Raptors jerseys (size and style at Contest Sponsors' sole discretion)
    • A one (1) hour shoot-around session with Chris Bosh (or alternate Raptor players or alumni selected at MLSE's sole discretion) for the Grand Prize winner and the Participants at NBA 3on3 in Toronto or at an alternative location on a date and at a time specified by Contest Sponsors in their sole discretion (which may be subject to change within Contest Sponsors' sole discretion). If the Grand Prize is scheduled and cancelled by the Grand Prize winner for any reason and cannot be rescheduled, the Grand Prize will be forfeited with no compensation or alternative prize awarded to the Grand Prize winner or the Participants.

    In the event the selected entrant is a minor, the Grand Prize will be awarded, subject to confirmation in accordance with these Contest Rules, to the parent/legal guardian of the selected entrant. All Participants must be 18 years of age or older or accompanied by their parent or legal guardian.

    Approximate Retail Value of Grand Prize is $3,000 CDN (subject to variation based on city of departure).

    All Grand Prize details including dates and time of travel, airline carrier, hotel, and seating shall all be at, and are subject to change at, Contest Sponsors' sole discretion. The eligible Grand Prize winner and his/her guests must be eligible for travel to Toronto and be prepared to travel together at times selected by the Contest Sponsors in their sole discretion. If the eligible Grand Prize winner is unable to travel to Toronto at the dates and time specified by Contest Sponsors he/she will be declared ineligible and a new entrant may be selected.

    The Grand Prize winner will have no entitlement to compensation in the event actual retail value is less than Approximate Retail Value.

    All costs and expenses not specifically included above as part of the Grand Prize, including, without limitation, ground transportation, insurance, taxes, meals, gratuities, concessions, souvenir items, phone calls, other transportation costs, laundry and mini-bar charges and any other personal and incidental expenses and any taxes thereon, are the sole responsibility of the Grand Prize winner and the Participants. The Grand Prize winner and/or the Participants may be required to present a valid major credit card upon hotel check-in to cover any incidental expenses.

  4. Draw:

    A random draw will be conducted at the offices of MLSE at, or about 11:59 a.m. EDT on July 7, 2009 from among all eligible entries received to determine the potential Grand Prize winner. The selected eligible entrant(s) will be notified by either telephone or email (depending on the contact information provided by the eligible entrant on the online entry form) between July 7, 2009 and July 10, 2009. Odds of being selected as a potential Grand Prize winner depend on the number of eligible entries received by Contest Sponsors during the Contest Period.

    Before being declared the Grand Prize winner, selected eligible entrant must: (i) correctly answer a time-limited mathematical skill-testing question without assistance of any kind, including use of a calculator; (ii) provide the Contest Sponsors with a Declaration of Compliance with the Contest rules and a Release of Liability and Publicity signed by both the selected Entrant and the Participants (or their respective parent/legal guardians in the event any of the forgoing are minors) releasing the Contest Sponsors, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective subsidiaries, affiliates, directors, officers, governors, agents (collectively, the "Released Parties") from any and all liability in connection with: (a) entrant and the Participants' participation in the Contest; (b) the acceptance and use of any Prizes awarded in the Contest; and (c) the administration of the Contest by the Contest Sponsors, including (without limitation) the selection of Prize winners or the distribution of Prizes awarded in this Contest.

    If a selected entrant cannot answer, or incorrectly answers, the skill-testing question, or fails to respond to the notification within twenty-four (24) hours of the first attempted contact or, fails to return the executed declarations and release documents, or MLSE is otherwise unable to contact the selected entrant within such time, or if a selected entrant otherwise does not meet any of the Contest eligibility requirements, or satisfy any other Contest conditions, that entry will be disqualified and another entry may be selected. The process may continue until the Grand Prize winner has been selected and confirmed. Following their confirmation as the Grand Prize Winner the selected entrant will be given instructions on how to claim their prize.

  5. General Rules:

    The Winner may not assign, transfer, or substitute prizes. Each prize must be accepted as awarded and no prize substitutions of cash or otherwise or transfer of the prize will be made, provided that the Contest Sponsors may make prize substitutions of equal or greater value. No telephone contact or correspondence will be entered into except with potential prize winners.

    By entering this Contest, each entrant consents to the use of his/her name, image, photograph, voice statement(s) and city of residence by the Contest Sponsors and the NBA, without further compensation, for any and all publicity purposes, commercial or otherwise, in all media. The Contest is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

    By entering the Contest, each entrant agrees to be bound by these rules and regulations and all decisions of the Contest Sponsors, which decisions are final with respect to all matters relating to the Contest, including (without limitation) the selection of prize winners.

    By entering the Contest, entrants agree to hold harmless and indemnify the Released Parties against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) entrant's participation in the Contest; (ii) the receipt or use of the prizes awarded herein; or (iii) the administration of the Contest (including winner selection) and distribution of the prizes awarded herein.

    Entrants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the entrant or any of the entrant's representatives, heirs, next of kin or assignees ("Entrant's Representatives") may have or which may hereinafter accrue to the entrant or Entrant Representatives against the Released Parties as a result of the entrant's participation in the Contest or the receipt or use of the Prize(s) awarded herein.

    The following are prohibited and will result in automatic disqualification from the Contest: (1) using any method that artificially increases odds of winning; (2) non-compliance with these Contest Rules; and (3) any other act which the Contest Sponsors determine, at their sole discretion, jeopardizes the integrity of the Contest.

    The Contest Sponsors may terminate, modify, suspend or withdraw from this Contest (and/or any aspect thereof, including methods for selection of the prize winners), in whole or in part, at any time without notice for any reason, without liability, at their sole discretion.

    No telephone contact or correspondence will be entered into except with the selected entrants.

    Contest Sponsors reserve the right to substitute prizes of equal or greater value and/or subject to the approval of the Régie des alcools, des courses et des jeux (‘RACJ') in respect of the Province of Quebec, to terminate, modify or suspend this Contest, in whole or in part, at any time, without prior notice for any reason, including, but not limited to, if viruses, bugs, tampering or other causes beyond the Contest Sponsors' control affect the administration, security, fairness or proper play of the Contest, and if the Contest is terminated, modified or suspended, to select potential winners from those eligible, non-suspect entries received prior to the event requiring such termination, modification or suspension. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including, without limitation, criminal prosecution.

    This Contest is subject to all applicable federal, provincial and municipal laws and regulations.

    All personally identifiable information submitted for this Contest in your contest entry ballot will be used only for the purpose of conducting this Contest. By completing the entry form all entrants consent and acknowledge that Contest Sponsors and/or their representatives shall have the right to use any and all information related to the Contest, including information on entrants obtained through the Contest, for purposes of administering the Contest.     The Contest Sponsors do not assume any responsibility for tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in damage or malfunction the computer or the failure of the Contest Sponsors to process any entry and otherwise award any prize. Nor is responsibility assumed for printing errors appearing in these rules or related Contest materials. In addition, the Contest Sponsors will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Contest or to remit the prizes to the winners results from a cause beyond their control, including Acts of God, weather conditions, strike, lock-out or other labour dispute.

    For Quebec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
